These are the rules for using Pudding. They are short on purpose. By using Pudding you agree to them.

What is Pudding, and who am I dealing with?

Pudding, in full "Pudding for Study", is a study app at pudding4study.app. It makes flashcards, quizzes and lecture notes from your own course. It is made and run by one independent developer in Adelaide, South Australia: [[OWNER: legal name]], ABN [[OWNER: ABN if registered]]. In these terms "we" and "us" mean that developer.

Who can use Pudding?

Accounts are for people aged 16 and over. Keep your password to yourself. Your account is for you, not for sharing. Paying for a plan is entering a contract. If you are under 18, a parent or guardian needs to agree to the purchase and make the payment with you.

What plans are there, and what do they cost?

  • Free. No payment.
  • Weekly. Billed every week. You can cancel any week. You can pause it for up to 12 weeks.
  • Lifetime. One payment.

Prices are shown in the app before you pay, and they are in Australian dollars. Payments are taken by Stripe. Pudding never sees or stores your card number.

How do I cancel or pause Weekly?

You can cancel in any week, and you will not be billed again after that. You can also pause the plan for up to 12 weeks.

Can I get a refund?

Yes. The promise on the payment screen is this: within seven days of paying you can have a full refund, no questions asked. To ask for one, you can email __SZ_SUPPORT_EMAIL__.

That promise sits on top of your rights under the Australian Consumer Law. Those guarantees apply to Pudding, and nothing in these terms limits them.

What does "Lifetime" mean?

It means the lifetime of the product, not your lifetime. You keep Lifetime access for as long as Pudding keeps running.

If we ever shut Pudding down, [[OWNER: state the notice you intend to give before a shutdown, and how long students will have to export their data.]] You can already export everything as a file at any time from Settings, Your data. Your rights under the Australian Consumer Law still apply.

What am I allowed to do with Pudding?

Use it for your own study. Please do not:

  • break into it, overload it, or get around plan limits;
  • resell it or share your account;
  • upload material you have no right to use, or anything unlawful;
  • use it to harm or harass anyone.

Who owns what I put in?

You do. Your cards, drafts, notes and recordings stay yours. You give us permission to store and process them only so the app can work for you. The Pudding name, the panda, the app and the preset packs belong to us. The Privacy Policy explains where your data goes.

Will Pudding write my assignment?

No. The Marking feature critiques your own draft against a rubric. It never writes the draft for you.

You are responsible for your own academic integrity obligations. Your university and your lecturers set the rules on which tools you may use and how. Check them, and follow them.

Can I rely on what Pudding tells me?

  • The preset degree packs are general first-year primers. They are not any university's syllabus, and they are not a substitute for your lecturer's material.
  • Cards, quizzes, notes, marking and transcripts are generated or extracted by software. They can be wrong. Check anything important against your course material.
  • The pace group in the league is simulated, and the app says so.
  • We do not promise that your marks or your study outcomes will improve.

What if something goes wrong?

You have guarantees under the Australian Consumer Law that cannot be taken away. Nothing in these terms excludes or limits them.

Beyond those guarantees, and as far as the law allows, Pudding is provided as it is. We do not promise it will always be available or free of errors. Export your data now and then, so you have your own copy.

Can my account be closed?

You can delete your account at any time in Settings, Your data. Cancel an active Weekly plan first. We may suspend or close an account that breaks these terms. That does not affect your Australian Consumer Law rights.

Can these terms change?

Yes. When they do, we will update the date at the top of this page. If a change affects a plan you have paid for, [[OWNER: say how, and how far ahead, you will tell paying students.]]

Which law applies?

The law of South Australia governs these terms, and the courts of South Australia hear any dispute about them.
